The Federal Court ruled today that the SPR is the rightful authority to decide when a legislature’s seat. However there are question to ask: What if the SPR is influenced not to declare a seat as vacant? Eg the previous Batang Ai State Assemblyman had been in coma for 9 months before he passed away. Practically he was no longer able to serve his constituency 9 months before he died. Did the SPR declare that he was incapacitated and therefore the seat was vacant?
Clearly there must be some more objective tests to eliminate possibly politicised decisions by the SPR. Perhaps in such circumstances the decision should be put to a proper court of law to make a definitive decision.
In any case the the win in Bkt Gantang by the ousted MB of Perak allowed the Perak folks a say that they still support the ousted MB. The Perak Sultan perhaps should reconsider his earlier appointment of an UMNO Assemblyman as the new MB of Perak. Let the people make their choice who to become their reps and MB, as proper in a Constitutional monarchy. A new state wide election is perhaps the only fair answer to allow the people speak for themselves.
