From a RTM report this evening the EC Chief Tan Sri Abdul Aziz said that he is not bound by the pronouncement of the Speaker of a State Assembly regarding whether there is/are vacancies in the State Assembly (or also Parliament?) and therefore whether to organise a by-election or not. This does not bode well for a by-election in Bkt Selambau in Kedah since the info about the Assemblyman Arumugam quiting could come from the Speaker of Kedah’s State Assembly-to be confirmed. Anyway let’s see what their decision is after the meeting in the morning.
In any case the policy to put the determination of the vacancy/ies in a State Assembly under the SPR’s jurisdiction will have major implication for the electoral arrangement in Malaysia. The vagueness of it all -of how EC were to determine the vacancies, may open spaces for partisan manuoverings, and thus impacting on the free and fair aspects of elections.
